United Networks – Data Centre Policy (hereinafter refer to as the "Policy")
Definition
Data Centre Refers to the United
Networks data centre located within United Network Solutions Limited (Data
Center Office) at Unit 2, 21/F., Block B, Wah Tat Industrial Centre, No. 8 Wah
Sing Street, Kwai Chung, N.T., Hong Kong mentioned in this web site http://www.unitednet.com.hk/contactus.htm .
Customer Refers to an organization that has connected to United Networks
facilities or has equipment collocated at the United Networks Data Centre.
Licensed Area Refers to that portion of the Data Centre made
available by United Networks to the Customer for the placement of Customer's
equipment and use of the Data Centre Services.
Representatives Refers to those individuals identified in writing
by the Customer on the United Networks Data Centre Access Authorization List
Form.
Site Access
1)
Only those Representatives identified in writing by the Customer on the
United Networks Data Centre Access Authorization List Form may make request to
enter the Data Centre.
2)
For every Data Centre visit, a maximum of 3 persons, of whom at least
one must be a Representative, may enter the Data Centre at the same time. For
security reasons, all visitors (Representatives and accompanying persons) will
be requested to show his/her Hong Kong ID Card or Passport for verification.
He/she will be refused to enter the Data Centre if the required credentials
cannot be shown.
3)
United Networks reserves the right not to allow entrance to the Data
Centre if the Data Centre already has too many companies performing works.
4)
Customer shall deliver prior written notice to United Networks of any
changes in the list of Representatives through the United Networks Data Centre
Access Authorization List Form.
5)
Customer and its Representatives may only enter its licensed area,
unless otherwise approved and accompanied by an authorized United Networks'
representative.
6)
Customer has full responsibility and liability for all acts or omissions
of Representatives and accompanying persons and all such acts or omissions will
be attributed to Customer for all purposes, including for the purposes of
determining whether Customer has breached this Policy.
7)
Each Customer must ensure that the Representatives and the accompanying
persons do not take any actions that Customer is prohibited from taking under
this Policy.
8)
Customer must provide United Networks with at least (1) one working day
prior notice via e-mail any time it intends to access the United Networks Data
Centre.
9)
Customer must provide United Networks with at least (3) three working
days prior notice any time it requires on site technical support at the United
Networks Data Centre or it intends to move-in or move-out any Customer
Equipment.
10)
The Representatives must fill in the details for access in the United
Networks Data Centre Access Form before they enter the Data Centre.
11)
The Representatives and the accompanying persons must wear our visitor
cards within the United Networks Data Centre.
Conduct at the Data Centre
1)
The Representatives and the accompanying persons must keep its licensed
area as well as United Networks Data Centre clean and tidy at all times.
2)
The Representatives and the accompanying persons agree to adhere to and
abide by all security and safety measures established by United Networks.
3)
The Representatives and the accompanying persons must refrain from doing
the following:
a)
engage in any activity that is in violation of the laws or aids or
assists any criminal activity while at United Networks property or in
connection with the Data Centre Services;
b)
misuse or abuse any United Networks' property or equipment or third
party equipment;
c)
make any unauthorized use of or interfere with any property or equipment
of any other customer;
d)
harass any individual, including United Networks personnel and
representatives of other customers; and
e)
use of any photographic, video, film or such other device that produces,
reproduces, retains or transmits images within the premises and the licensed
space.
4)
Customer must not, except as otherwise agreed by United Networks,
(1)
place any computer hardware or other equipment in the Licensed Area
(2)
store any other combustible materials of any kind in the Licensed Area;
and
(3)
bring any "Prohibited Materials" (as defined below) into the
Data Centre. Prohibited Materials shall include, but not limited to, the
following and any similar items:
(a)
Food, drink, illegal drugs and other intoxicants
(b)
Tobacco products
(c)
Explosives and weapons
(d)
Hazardous materials
(e)
Electro-magnetic devices, which could unreasonably interfere with
computer and telecommunications equipment
(f)
Radioactive materials
(g)
Photographic or recording equipment of any kind
(h)
Any other items deemed inappropriate at United Networks' sole
discretion.
5)
All of Customer's equipment must be installed, operated, configured and
run at all times in compliance with the manufacturer's specifications,
including power outlet, power consumption and clearance requirements and the
applicable laws.
6)
All Customer's Equipment must be put within United Networks' licensed
area, and they must be either rack-mounted, or be put on United Networks'
provided fixed partitions. None of Customer's equipment is allowed to stack or rest on the
equipment of any other Customer;
7)
All of the cables and wiring in Customer's licensed area must be neatly
labeled, wrapped and tied together (if a customer fails to do so, United
Networks may in its sole option neatly wrap and tie such wires and cables, and
United Networks may charge the customer for performing such service);
8)
Customer cannot store any illegal content on his/her server(s) or on our
server(s). Otherwise, customer must bear all charge of these behaviours by
other parties;
9)
Customer cannot create and send any spams or
attack other servers via our network. Otherwise, customer must bear all charge
of these behaviours by other parties.
Electrical Power
1)
Each of United Networks' standard cabinet is provisioned for 13A power
consumption, and the maximum number of power sockets allowed are that
previously agreed by United Networks. The Customer could only use those power
sockets as assigned by United Networks.
2)
It is the Customer's sole responsibility to ensure that the power
provided as agreed by United Networks
is sufficient to power the devices for regular use.
3)
United Networks may independently inspect the
power configuration of any cabinet with Customer's licensed space, at any time.
4)
United Networks may direct Customer
a)
to alter the power configuration of Customer's
equipment;
b)
to disconnect power supply to the Customer's
equipment; or
c)
require Customer to remove from any equipment, if
United Networks considers that the continued operation of Customer's equipment:
(a)
causes a threat to safety to the operations of
United Networks' Data Centre or the Data Centre property;
(b)
unreasonably interferes with the operations of
United Networks, any other customer or any entity utilizing any portion of the
Data Centre;
(c)
is not installed in accordance with standard
industry practice; and/or
(d)
is consuming or has consumed excessive power.
5)
United Networks reserves the right to disconnect
any unauthorized power connection made by Customers without notice.
6)
If the Customer fails to settle any debt due,
United Networks reserves the right to disconnect power
connected to customer’s equipment after
advice by our A/C department. And it is entitled for
us to sell
the related equipment at any price in such manner as it deems
fit for payment of any such debt and the cost of sale shall be solely borne by
the Customer.
Compensation
1)
United Networks provide
rental service or colocation service to customer. She has no responsibilty for
maintenance of customer’s data, software and
equipment (like server) …etc.
2)
Customer need to do backup
for his/her data regularly in order to avoid data loss due to hardware failure.
3)
United Networks will
NOT do any compensation for data loss due to any reason.
4)
United Network will NOT
do any compensation for hardware failure except accident like fire or water
caused by our data center. The amount of compensation will be decided by our
insurance company.
5)
United Networks will
NOT do any compensation for an industrial injury if customer does NOT follow
our instruction to operate our facilities. Compensation for an industrial
injury will be valid only due to accident caused by fault of facilities in our
Data Center. The amount of compensation will be decided by our insurance
company.
6)
No compensation for any loss due to no power
within one day due to MA.
Remarks
If Customer breaches any of
the terms mentioned in this policy, United Networks reserves the rights to
suspend or to disconnect the services partly or wholly, or restrict Customer or
its Representatives from accessing the licensed area without incurring any
liabilities or obligations.
United Networks may change this Policy from time to time and the
revised Policy shall be posted at United Networks Homepage at http://www.unitednets.net. Customer is required to
review United Networks' website regularly to keep itself informed of the most
current version of this Policy at all times
